Compliance with applicable law:
Flickering Torches is an unincorporated membership association. The membership includes and/or has included consultants, forensic scientists, journalists, photographers, counselors, clergy and practitioners of Chinese metaphysics. No activity of the association shall be construed to require a professional license or certification to consult with clients. For purposes of compliance with the laws of the state of Washington, the equivalent laws of the other states and of the federal government, the members of Flickering Torches while acting on behalf of the association are described by the following:
Although we frequently use the related terms “investigate”, “investigator”, and “investigation” on this website, members of the association are not private investigators, do not represent themselves as such, and do not create an agency relationship with anyone while acting under the name of the association. Any activity which involves gathering, handling or analyzing physical and/or electronic evidence is done so under the forensic science exemption provided by RCW 18.165.020(10). Any member of the association acting as a counselor does so according to RCW 18.19.040(3), (6), and/or (7). Any member whose practice of Chinese metaphysics includes subjects mentioned in the rules governing East Asian medicine practitioners does so according to RCW 18.06.010(1)(k) through (o). Religious, journalistic (including photographic), and group activities are protected by the First Amendment of the U.S. Constitution.
The legal protection of the activities of the members of the association shall not be limited by the foregoing and shall be considered amended hereto in favor of the rights of the association and its members to remain free of license according to existing law and/or applicable changes at law. Nothing in this section shall restrict a member of the association from separately engaging in an activity subject to license or other regulation outside of association activities.
